Note that the statute on unlawful presence provides for *no* incarceration or
other criminal penalties:

The most that can happen is the alien may be deported.
Improper entry is a crime, but it is a commonplace that the large majority of
aliens who are unlawfully present did *not* commit improper entry. They entered
the country entirely properly and legally on valid visas, then failed to leave
on or before the expiration date of their visas.
Unlawful presence is not a crime.
